A notice sent to the address or email above reaches the brokerage. Blue Fence Real Estate should also keep its designated agent registered with the U.S. Copyright Office, which is what preserves safe-harbor protection under the statute.
What your notice must include
To be effective under 17 U.S.C. § 512(c)(3), a notice must be a written communication that includes all of the following:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim has been infringed — or, if multiple works are covered by one notice, a representative list of them.
- Identification of the material you claim is infringing, with enough detail for us to locate it. Please include the full URL of the page and a description of the specific photograph or text.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorized to act on the owner’s behalf.
Be aware that under 17 U.S.C. § 512(f) a person who knowingly misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.
What happens next
- We review the notice and, if it is complete, remove or disable access to the identified material promptly.
- We notify the party who supplied the material, where we can identify them, and provide a copy of your notice.
- That party may submit a counter-notice as described below.
- We keep a record of notices and may terminate access for repeat infringers.
Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the designated agent containing: your signature; identification of the removed material and the location where it appeared; a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; and your name, address, and telephone number, together with consent to the jurisdiction of the federal court for your judicial district (or, if you are outside the United States, for any district in which we may be found) and consent to accept service of process from the party who filed the original notice.
If we receive a valid counter-notice, we may restore the material in 10 to 14 business days unless the original complaining party notifies us that it has filed an action seeking a court order.

Listing content displayed on or linked from this site is provided courtesy of Midwest Real Estate Data LLC (MRED). Copyright in listing photographs generally belongs to the listing brokerage or the photographer it engaged. If your claim concerns a listing photograph, identifying the MLS number along with the URL will help us route the notice correctly, and we may also refer the matter to MRED.
